Hi there everyone. It’s Matthew Pryke, notary public and solicitor based in London. Now if there’s one question I get asked more than any, and it’s obvious why I get asked it, it’s what is it going to cost? People want to know when they’re getting documents notarised legalised, what’s the cost going to be? So I put together this blog together to give you a few tips and hints on how you can get the best price from the notorious you are speaking to.

Always get a quote

The first one is to get a quote in advance. If you provide a copy of the documents and you provide the information that you need, then the notary should be able to provide you with a fixed fee quote in advance of meeting with you that allow you to shop around and work out whether you’re happy to pay that amount.

Let the Internet help you

Secondly, the rest of the comparison sites out there, there’s an excellent one called findmynotary.co.uk. That will allow you to search on a geographical basis and then there are fee details that. There are even fee comparisons that will allow you to determine whether the no for your speaking to is the one that has the price that is most appropriate for you. I should add on this though, the price isn’t, the only thing that matters often for most of my clients is whether the matter can be dealt with quickly, efficiently and professionally. And sometimes that’s worth paying a little bit more for.

Fancy saving 20% on the Notary Fees?

But then once you’ve given being given the quote, the other things you need to kind of think about are there any additional fees? So for example, a big one will be is that notary registered for VAT or that. And what that really means is are you going to have to pay another 20% now if you’re a business shopping around for a notary, you’re probably not going to care about that cause the chances are you’re going to be registered for that as well. And so you’re going to be able to recover the amount. But if you’re a person who’s not registered for that and that 20% is significant. So again, not all notary, if I’ve registered for that. So think about whether you can find one. You can create a 20% saving for you by not charging tax on the fees that you have to pay.

More Fees you say!

The third area is thinking about whether there are any additional fees around Legalisation, particularly embassy fees or having to go to the foreign and Commonwealth office. Again, if you want to save on fees, this aspect of those things that you can probably do yourself. And if you want to watch some of our video guides, we even show you how to do that. But the key is often that’ll involve more time from you. So again, sometimes it’s worth spending the money to know that people, notary practices in London like mine who deal with these embassies and Foreign and Commonwealth Office on a day to day basis, we’ll be able to deal with things efficiently and accurately. So ultimately your documents get accepted when they go to the country they’re going to.

So those are a few tips on how to go and get quotes and fees that are the best and appropriate for what you want. And thanks again for watching. If you need to legalise a document for use in China you will need to deal with the Chinese Embassy in London. The Chinese Embassy is very particular about the manner in which Notarised documents can then be legalised. Once the document is notarised it must then be legalised by way of Apostille certificate issued by the Foreign and Commonwealth Office.  The next step is to present this legalised and notarised document to the Chinese Embassy, so additional Consular stamps can be added.

There are 4 requirements imposed by the Chinese Embassy which must be followed very carefully, these include:

  1. The Notarised document must be bound with legal tape (often ribbon) and the ends sealed with an embossed Notary stamp. This applies even if the bundles have been bound with a brass rivet.
  2. A copy of the passport of any signatory must be presented at the Chinese Embassy.
  3. If the signatory is signing on behalf of a body corporate, evidence of his or her capacity to sign must be supplied, usually via a Notarised list of directors taken from Companies House,
  4. A letter from the signatory authorising the Notary or Legalisation Agent to proceed on the clients behalf.

Documents for use in Spain (including the Canary Islands) should be certified by the UK Foreign and Commonwealth Office (“FCO”) by way of Apostille.

The legalisation fee is £69 for each document and documents will be processed within 24 hours if lodged with the FCO before 2pm.

The FCO has two legalisation offices. The public legalisation office is situated in Milton Keynes, roughly 55 miles north of London. The FCO will usually charge £30 per Apostille certificate. Documents will usually need to be signed before a London Notary Public and then notarised in advance of being presented to the FCO. The FCO has another office located near St James’s Park, in London. This FCO office is only open to Notary Publics and a few other businesses for the premium legislation service only. The FCO will charge £75 per Apostille. Members of the public cannot use this service, however notaries can lodge documents on behalf of a client who wishes to utilise the premium legalisation service.

Using of a Notary Public can sometimes be confusing, especially as there is can be some jargon involved. We’ve put together a guide for our Notary Public Clients of some common technical words used when notarising the legalising documents.

Affiant – The person signing an Affidavit.

Affidavit – A written statement of evidence which is signed before a person authorised to administer affidavits such as a Notary Public.

Affix – Attaching or impressing the Notary Seal to a document.

Authenticate – Most commonly, authentications are requested for documents that are bound for a foreign country. A document is authenticated by attaching an Apostille or certificate of authority to it.

Apostille, Apostillized, Apostille Certificate – The legalization certificate, or certificate of authority, issued by the Legalisation Department of the Foreign and Commonwealth Office.

Certify – To authenticate or attest a document as being true or represented.

Commission for Oaths – A Notary Public or other professional authorized to administer an oath to a person making an affidavit. For further information please visit.

Deed Poll – A Deed Poll is a form of legal contract which only concerns one person and is signed by that person in presence of a witness. A Deed Poll is a name to legally changes the name of the person who signs it.

Identification document – The evidence used to confirm identity. This will usually be a current passport and a bank statement or utility bill to confirm your residential address.

Notarisation – The process of a Notary Public adding a Notary Stamp and Notary Seal to a document.  

Notary Legalisation – The process by which the signature and seal of the notary are authenticated by the Foreign Office and/or the Embassy or Consulate of the country in which the document is to be used. This process varies depending on the country.

Notary Public, Public Notary or Notary – The role of a Notary Public is to verify, corroborate, prepare and certify legal documents for global use.

Notary Seal – The imprint or embossed impression of a Notary Public’s stamp.

Notarisation – This is the term used to describe how a Notary Public witnesses and certifies the execution of the document or confirms a legal principle or fact. Often notarisation requires the Notary Public to draft of a specific and suitable notarial certificate.

Notarial Act – An official act that a Notary Public is authorized to perform by statute. Can be in Public or Private form and is also sometimes referred to as a Notarial Deed.

Notarial translation – A Notary will affirm the translation is a true representation of the original document.

Power of Attorney – A document giving a person authority to act for another person in specified or all legal or financial matters.

Signatory – A person who has signed an agreement or contract.

Statutory Declarations – A prescribed declaration, made under statutory authority, which may in certain cases be substituted for a statement on oath before a Notary Public.

Witness – To observe the signature or execution of a document in order to authenticate it.
