Hi there everyone. It’s Matthew Pryke, notary public and solicitor based in London. Now if there’s one question I get asked more than any, and it’s obvious why I get asked it, it’s what is it going to cost? People want to know when they’re getting documents notarised legalised, what’s the cost going to be? So I put together this blog together to give you a few tips and hints on how you can get the best price from the notorious you are speaking to.

Always get a quote

The first one is to get a quote in advance. If you provide a copy of the documents and you provide the information that you need, then the notary should be able to provide you with a fixed fee quote in advance of meeting with you that allow you to shop around and work out whether you’re happy to pay that amount.

Let the Internet help you

Secondly, the rest of the comparison sites out there, there’s an excellent one called findmynotary.co.uk. That will allow you to search on a geographical basis and then there are fee details that. There are even fee comparisons that will allow you to determine whether the no for your speaking to is the one that has the price that is most appropriate for you. I should add on this though, the price isn’t, the only thing that matters often for most of my clients is whether the matter can be dealt with quickly, efficiently and professionally. And sometimes that’s worth paying a little bit more for.

Fancy saving 20% on the Notary Fees?

But then once you’ve given being given the quote, the other things you need to kind of think about are there any additional fees? So for example, a big one will be is that notary registered for VAT or that. And what that really means is are you going to have to pay another 20% now if you’re a business shopping around for a notary, you’re probably not going to care about that cause the chances are you’re going to be registered for that as well. And so you’re going to be able to recover the amount. But if you’re a person who’s not registered for that and that 20% is significant. So again, not all notary, if I’ve registered for that. So think about whether you can find one. You can create a 20% saving for you by not charging tax on the fees that you have to pay.

More Fees you say!

The third area is thinking about whether there are any additional fees around Legalisation, particularly embassy fees or having to go to the foreign and Commonwealth office. Again, if you want to save on fees, this aspect of those things that you can probably do yourself. And if you want to watch some of our video guides, we even show you how to do that. But the key is often that’ll involve more time from you. So again, sometimes it’s worth spending the money to know that people, notary practices in London like mine who deal with these embassies and Foreign and Commonwealth Office on a day to day basis, we’ll be able to deal with things efficiently and accurately. So ultimately your documents get accepted when they go to the country they’re going to.

If you need to legalise a document for use in China you will need to deal with the Chinese Embassy in London. The Chinese Embassy is very particular about the manner in which Notarised documents can then be legalised. Once the document is notarised it must then be legalised by way of Apostille certificate issued by the Foreign and Commonwealth Office.  The next step is to present this legalised and notarised document to the Chinese Embassy, so additional Consular stamps can be added.

There are 4 requirements imposed by the Chinese Embassy which must be followed very carefully, these include:

  1. The Notarised document must be bound with legal tape (often ribbon) and the ends sealed with an embossed Notary stamp. This applies even if the bundles have been bound with a brass rivet.
  2. A copy of the passport of any signatory must be presented at the Chinese Embassy.
  3. If the signatory is signing on behalf of a body corporate, evidence of his or her capacity to sign must be supplied, usually via a Notarised list of directors taken from Companies House,
  4. A letter from the signatory authorising the Notary or Legalisation Agent to proceed on the clients behalf.

HM Passport Office has for some years been incorporating electronic images of signatures onto the British Passports that it issues. A decision has now been made to revert to manual hand written signatures in an updated style of passport which our notaries office understand is about to be issued.  On this basis passport holders receiving this new passport will, to ensure the passport is valid, be required to sign in black biro on a new page which our Notary Offices understand will precede the information page.

The new passports provide an additional verification requirement for Notary Publics. In particular, Public Notaries should check and confirm that any passport requested to be notarised has been duly signed in the appropriate manner and location.  Often notarised passports are required to be legalised by way of Apostille Certificate issued by The Foreign and Commonwealth Office.  These notarised passport copies are only likely to be accepted by the FCO and issued with an Apostille if the notarised copy sent to the Legalisation Office is signed.  Our Notary’s Office expects that unsigned notarised passport copies will likely be rejected.

At our Notary Public offices we provide a same day legalisation service for Notary clients who needs documents fully Legalised at short notice. Simply put, an Apostille is a certificate attached to an official document that authenticates that document by certifying the signatures/stamps are genuine. The key point is that an Apostille allows that document to be accepted in other countries without further legislation. What notarised documents can be legalised in this way? Apostille can legalise public documents that bear an original signature, seal or stamp from a UK public organisation or official such as a Notary Public. Examples of the types of document that may can be legalised include:

Apostille Examples

  • birth certificates,
  • patent applications and
  • court orders.

The legalisation certificate is approximately 15cms square and is permanently glued to the official document that is embossed with the Apostille seal or stamp. The country producing the document in need of authentication will issue an Apostille certificate and then that document will enjoy acceptance by the countries that recognise the Apostille. These countries that have abolished the requirement of legislation for foreign public documents, thereby accepting Apostilles, are those that are party to the Hague Convention 1961.

An official document can obtain an Apostille by a competent authority. In the UK, The Legislation Office of the Foreign and Commonwealth Office is the only competent authority to issue legislation or Apostille certificates. The fee is £30 per Apostille. Registered businesses, such as London Notaries Public, however can take advantage of the premium service offered by the Foreign & Commonwealth Office Legislation Office in Central London. Documents lodged here can be returned the same day for a fee of £75 per Apostille. Set out below is an example of an Apostille:

If documents are intended for use in Germany, they should be certified by the UK Foreign and Commonwealth Office by way of Apostille (“FCO”).

The legalisation fee is £75 per document and documents will be processed the same day if lodged with the FCO before 14:00 hours. The FCO has two legalisation offices. The public legalisation office is situated in Milton Keynes, roughly 55 miles north of London. The FCO will usually charge £30 per Apostille certificate. Documents will usually need to be signed before a London Notary Public and then notarised in advance of being presented to the FCO.

The FCO has another office located near Admiralty Arch, in London. This FCO office is only open to Notary Publics and a few other businesses for the premium legislation service only. The FCO will charge £75 per Apostille. Notaries can lodge documents on behalf of a client who wishes to utilise the premium legalisation service.

Documents for use in Antigua and Barbuda require legalisation by the UK Foreign and Commonwealth Office (“FCO”).

Documents lodged before 2pm at the Legalisation Office of the FCO can be returned fully legalised the same day. An Apostille Certificate requires a legalisation fee of £75 per document.
