Hi there. I’m Matthew Pryke Notary Public and solicitor based in London. Thanks for all the Notary questions and queries you’re sending in. We love dealing with them. Anything we can do to make the process of notarising documents more straight forward. We’re super excited about helping you with. So somebody has asked me a question about Deed Polls. This certainly seems to be an area where there seems to be quite a lot of confusion. Now, what is a Deed Poll? A Deed Poll is a document which somebody can sign to legally change their name. So what they’re effectively saying by signing that document is their previous name, that may be a maiden name or it may be just a name that they’ve changed from a previous name they don’t like, they’re not going to use moving forward. Actually what they’re going to do is use a new name exclusively as their lawful name.

Now the document, the Deed Poll, itself is not a complicated document. In fact, if you look on the internet, you can find lots of examples of templates. Do go carefully though because I’ve seen some of those templates are actually produced wrongly. So when it’s something as crucial as changing your name, I would suggest making sure that at least somebody who is legally qualified has a look at it to make sure it’s correct. But once you’ve got your correct name change template, the real confusion appears to be a misunderstanding over the witnesses to the signing of the Deed Poll. Now there’s quite a few companies out there which suggest or imply the document needs to be stamped or it needs some professional to sign and stamp the Deed Poll. Actually that isn’t always the case. In fact, in the large majority of occasions, a professional signature and stamp aren’t necessary for the document to be legally binding within the UK. It just needs to have independent witnesses and the independent witness doesn’t need to be a professional like a solicitor or a qualified Notary Public.

What it really needs to be is someone who is genuinely independent, so not connected with the person who is signing the documents to change their name. So a family member or something similar wouldn’t be appropriate, but the only time when a document would need to be signed by a legal professional such as a UK Notary Public is usually if the document is going to be used overseas and it needs to be recognized as being legally enforceable within a foreign country. Now the confusion, unfortunately, means that lots of people end up spending money with law firms or with other organisations when they really don’t need to spend this money. Unfortunately I see lots of documents on this basis, it’s one of those where I’m trying to avoid people having to waste money and so I’ll point out to them, but actually they didn’t need to do that. I see it so often and when I explain people are often disappointed.

So I am trying to help people to change their name without spending cash. Using of a Notary Public can sometimes be confusing, especially as there is can be some jargon involved. We’ve put together a guide for our Notary Public Clients of some common technical words used when notarising the legalising documents.

Affiant – The person signing an Affidavit.

Affidavit – A written statement of evidence which is signed before a person authorised to administer affidavits such as a Notary Public.

Affix – Attaching or impressing the Notary Seal to a document.

Authenticate – Most commonly, authentications are requested for documents that are bound for a foreign country. A document is authenticated by attaching an Apostille or certificate of authority to it.

Apostille, Apostillized, Apostille Certificate – The legalization certificate, or certificate of authority, issued by the Legalisation Department of the Foreign and Commonwealth Office.

Certify – To authenticate or attest a document as being true or represented.

Commission for Oaths – A Notary Public or other professional authorized to administer an oath to a person making an affidavit. For further information please visit.

Deed Poll – A Deed Poll is a form of legal contract which only concerns one person and is signed by that person in presence of a witness. A Deed Poll is a name to legally changes the name of the person who signs it.

Identification document – The evidence used to confirm identity. This will usually be a current passport and a bank statement or utility bill to confirm your residential address.

Notarisation – The process of a Notary Public adding a Notary Stamp and Notary Seal to a document.  

Notary Legalisation – The process by which the signature and seal of the notary are authenticated by the Foreign Office and/or the Embassy or Consulate of the country in which the document is to be used. This process varies depending on the country.

Notary Public, Public Notary or Notary – The role of a Notary Public is to verify, corroborate, prepare and certify legal documents for global use.

Notary Seal – The imprint or embossed impression of a Notary Public’s stamp.

Notarisation – This is the term used to describe how a Notary Public witnesses and certifies the execution of the document or confirms a legal principle or fact. Often notarisation requires the Notary Public to draft of a specific and suitable notarial certificate.

Notarial Act – An official act that a Notary Public is authorized to perform by statute. Can be in Public or Private form and is also sometimes referred to as a Notarial Deed.

Notarial translation – A Notary will affirm the translation is a true representation of the original document.

Power of Attorney – A document giving a person authority to act for another person in specified or all legal or financial matters.

Signatory – A person who has signed an agreement or contract.

Statutory Declarations – A prescribed declaration, made under statutory authority, which may in certain cases be substituted for a statement on oath before a Notary Public.

Witness – To observe the signature or execution of a document in order to authenticate it.

In recent months we have received an increasing number of individuals contacting the website who want to change their name. There are a number of guides to changing your name and how to execute and use a Deed Poll already on the site. However we have produced a quick summary guide in response to the many recent Deed Poll enquiries.

The first point to make is you don’t have to follow a legal procedure if you want to adopt a new name. Whilst this is the case, you are likely to need a deed poll to apply for or change your name within official documents, like a passport or driving licence.

A deed poll is a legal document that allows you to prove or evidence a change of name. In has been confirmed that Oscar-winning actress Kate Winslet has married again. Rather than this news being greeted as a cause for celebration it is the name of her new husband that has become the biggest talking point!

The 37-year-old, married Ned Rocknroll, a nephew of music and aviation tycoon Richard Branson. According to online reports, Rocknroll had his name changed by deed poll from Ned Abel Smith and is a marketing executive for Virgin Galactic. Whilst many have questioned the validity of such an unusual name it shows the opportunity that a Deed Poll name change document can offer to someone who wants the freedom to be “creative” with their identity.

This story follows hot on the heels of news that Midlands-based impersonator “Gordon Elvis” won the annual European Elvis Championships in Birmingham. This Malta born impersonator also used a change of name deed poll to honour the late rock and roll singer.

Both stories illustrate how people are choosing to change their names for a range of reasons. Some of those reasons can more “traditional” in nature, such as marriage, divorce or adoptions, whilst others change their name out of personal choice. So long as an individual is not changing their name for fraudulent purposes, it doesn’t matter what the reason is. It is an indivduals right to be known by whatever name they wish (subject to certain restrictions).

The Notary Public London Guide has previously mentioned the Deed Poll name change controversy on the ITV show, X Factor, when Simon Cowell refused to call a contestant by the name ‘Storm’.

We pointed out that not only is a name change by Deed Poll completely legal, and that Simon Cowell was incorrect to refuse to call the singer by his new name, but also what an easy process changing a name could be.  So we were delighted to learn this week that in a follow up show to the X Factor, Simon Cowell signed a Deed Poll name change document himself.

After ascertaining that he could hold the contract himself, Cowell signed the forms to declare that he would officially be called ‘Lightening’, albeit for a 24 hour period.

Changing a name by Deed Poll hit the public consciousness once more on Saturday night, when viewers of the X Factor saw a performance by a contestant called ‘Storm’. Simon Cowell said, ‘I’m not going to call you Storm any more…. What’s your real name, the name you were born with?’

The contestant revealed that he had changed his name by Deed Poll from ‘Lee Gardner’ to ‘Storm Lee Gardner’.

Changing a name by Deed Poll is legally binding and the contestant had every legal right to insist on being called by his new name.  The name change by Deed Poll took place when Storm was 16 years old and so he wouldn’t have needed parental permission to change name.

Is my free name change legally binding?

The free Deed Poll document is legally binding and will be accepted as proof of your name change by all government agencies.  It will also be accepted by Banks and Building societies, the DVLA and medical agencies.

Can I avoid creditors by changing my name by Deed Poll?

No.  It is illegal to change your name for the purpose of trying to avoid debts or to misrepresent yourself in any way.  Once you change your name by Deed Poll you are obliged to inform all official agencies of the name change.

Can I use my Deed Poll to change my Birth Certificate?

It is highly unusual to change the name on a Birth Certificate.  The Birth Certificate is an official record that declares a person’s name in their infancy, rather than the name they wish to assume.  There are certain circumstances where Birth Certificates can be altered but a Deed Poll is not used to make these changes.
